Overview

The Race Horse Development and Gaming Act of 2004, known as Act 71, authorized 14 slot machine gaming operator licenses to be awarded to applicants approved by the Pennsylvania Gaming Control Board which was also established under the same act. Several major objectives of Act 71 are to deliver a significant source of revenue for property tax relief, provide additional jobs and reinvigorate the Pennsylvania horse racing industry.

The three casino categories along with the number of operator licenses authorized for each under Act 71 are as follows:

Category 1 – Horse Racing Facilities ( 7 Licenses )
Category 2 – Stand Alone Facilities ( 5 Licenses )
Category 3 – Resort Facilities ( 2 Licenses )

As of December 31, 2009, 12 of the 14 licenses have been awarded of which 9 facilities are operating at various locations across the State. The remaining two licenses are for a Category 1 Horse Racing Facility, Valley View Downs which is waiting for approval and a Category 3 Resort Facility License which has not yet been awarded. Pennsylvania Gaming Control Board

Established with the passage of the Race Horse Development and Gaming Act of 2004, the Pennsylvania Gaming Control Board was created to oversee every aspect of the authorization, operation and regulation of casino gaming in the Commonwealth. Its objectives are to ensure the success, integrity and fairness of gaming across the state of Pennsylvania.

The Pennsylvania Gaming Control Board provides regulation and oversight through the testing and certification of all slot machines and electronic gaming equipment. All machines must meet minimum design standards and return a minimum 85% payback ratio over the lifetime of the machine.

On-site enforcement of internal controls at each casino facility is a major priority of the Pennsylvania Gaming Control Board to ensure an immediate response to patron complaints and quickly initiate investigations.

A Pennsylvania tax rate of 55% is levied on revenue earned from slot machine play. This means that for every dollar produced as revenue from slot machine play, 55 cents is returned to Pennsylvanians.

It Pays to Play in PA... for PA Casino Patrons because Pennsylvania law requires slot machines to pay back a minimum of 85% of what is wagered in the slot machines. The Pennsylvania requirement is higher than the current laws in both New Jersey at 83% and Nevada at 75%.
